JEANS FOR GENES 2023 CUTE SHOOT COMPETITION - CONDITIONS OF ENTRY

  • The Jeans for Genes 2023 Cute Shoot Competition is being conducted by Children’s Medical Research Institute, ABN 47 002 684 737 (CMRI). CMRI is a charity registered by the Australian Charities and Not-for-Profit Commission. CMRI can be contacted at this telephone number: 1800 436 437.
  • These Conditions of Entry describe how you can enter the Jeans for Genes 2023 Cute Shoot Competition.
  • Entry to the Jeans for Genes 2023 Cute Shoot competition commences at 12pm (midday) AEDT on Monday 5 June 2023 and closes at 12pm (midday) AEDT on Monday 24 July 2023 (Entry Period).
  • You have to be an Australian resident and be at least 18 years of age to enter the Jeans for Genes 2023 Cute Shoot Competition.
  • You have to accept these Conditions of Entry to be eligible to win a prize. If you register for and/or participate in the Jeans for Genes 2023 Cute Shoot Competition, your registration is taken to mean that you have accepted these Conditions of Entry.
  • The laws of Australia apply to the Jeans for Genes 2023 Cute Shoot Competition to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.

ENTRY TYPES

1. Type: Baby Entries

  • Australian residents can enter their own living child or grandchild who is aged from newborn to 5 years and is an Australian resident as at 5 June 2023. This means a child born before or on 5 June 2018. Before you enter a child, you must have the approval of each of the child’s parents and/or legal guardians.
  • In these Conditions of Entry, an eligible child who is entered into the competition is referred to as an Entered Child.
  • Children from the same multiple birth (e.g. children who are twins or triplets) may be entered in the competition either individually or as a group. If they are entered as a group, it is referred to a Multiple Birth Entry. In any Multiple Birth Entry, all living children from the same multiple birth must be included in the entry and depicted in a single photograph. A child cannot be entered into the competition both individually and as part of a Multiple Birth Entry. References to a baby, child or Entered Child in these Conditions of Entry refer to each child in any Multiple Birth Entry.
  • Any Entered Child depicted in an entry must be wearing at least a nappy (or have equivalent coverage of their body as would be provided by a nappy) as well as being dressed with some denim element, such as a denim bandana, scarf, hat, trousers, shirt, or jacket.
  • There are no separate age categories within the Baby Category. This means that the judges will select a winner from the pool of all Entered Children (from newborn to 5 years of age).
  • You may be required to provide a copy of the Entered Child’s birth certificate at CMRI’s request.

2. Type: Fur Baby Entry

  • Australian residents can enter their own living dog or cat. Entrants agree to provide proof of pet ownership on request e.g. a photograph of themselves with the pet and their pet registration papers.
  • In these terms and conditions, the entered dog or cat is referred to as the Entered Pet.
  • Dogs and/or cats from the same litter or from the same household may be entered as a Multiple Pet Entry either individually or as a group. If a dog or cat is entered as part of a group, it cannot be entered into the competition both individually and as part of a Multiple Pet Entry.

HOW TO ENTER

3. In these Conditions of Entry, each Entered Child and Entered Pet entry (including a Multiple Birth Entry or a Multiple Pet Entry), is referred to as an Entered Individual.

4. To enter the Jeans for Genes 2023 Cute Shoot Competition entrants must:

  1. photographs must be in jpeg, gif or png form and 1MB to 5MB in size;
  2. only a single photograph, depicting a single image of the Entered Individual, is accepted per entry;
  3. the Entered Individual must be clearly identifiable and the most dominantly featured person or animal in the entered photograph;
  4. photographs must be of the Entered Individual and taken no more than 5 years prior to entry; and
  5. entrants must own the copyright of any photograph uploaded or otherwise be entitled to use the photograph in this way;
  • fill in and submit the entry form online at the Competition Website.

5. An Entered Individual may be entered a maximum of 5 times into the Jeans for Genes 2023 Cute Shoot Competition, but each entry must use a different image.

6. Entrants warrant and agree that, without limitation:

  • they will not submit any material (including without limitation, the entry itself, images, answers to questions, posts or comments on the Competition Website or elsewhere in relation to this competition or any entrant or entry) (Content) that is unlawful or fraudulent or that may be in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, politically incorrect, violent, abusive, harassing, threatening, racist, ageist, sexist, objectionable with respect to religion, origin or gender, not suitable for children under 15, or otherwise unsuitable for publication in the context of this competition;
  • they will only submit Content which they have personally created or have the right to submit;
  • their entry will not contain viruses or cause injury or harm to any person or entity;
  • if submitting an entry as a Baby entry, they have the approval of all parents and/or legal guardians of the Entered Child;
  • they will comply with these Conditions of Entry and with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems;
  • they have the full authority to grant CMRI the rights referred to in these Conditions of Entry; and
  • they will indemnify CMRI against all costs and claims by third parties arising from a breach these Conditions of Entry.


7. Entrants agree:

  • they are fully responsible for the Content which they submit. CMRI may, in its sole discretion, determine whether an entry will be posted, or remain posted on its websites. CMRI reserves the right to vet or remove any Content at any time in its absolute discretion. However, CMRI is not responsible for any Content uploaded to the site and visitors to the site view it at their own risk. Notwithstanding any decision by CMRI to post Content on its website, the terms and warranties set out in these Conditions of Entry continue to apply;
  • to waive, and hereby do waive, any legal or equitable rights or remedies they have or may have against CMRI with respect to the entries and Content they submit and their use of the Competition Website, and agree to indemnify and hold CMRI, its officers, agents and affiliates harmless to the fullest extent allowed by law regarding all matters related to their use of the site;
  • to report abuse, harassment, inappropriate content or privacy complaints by emailing [email protected]. CMRI reserves the right to remove any Content from the Competition Website and invalidate any associated entry without prior notice and for any reason it sees fit in its sole discretion, including if properly notified that such material infringes on another's intellectual property rights.

8. CMRI reserves the right, at any time, to verify the validity of entries, entrants and votes. CMRI has the right to invalidate any entry which it considers to be (or may be) in breach of these Conditions of Entry. CMRI’s decision in relation to all aspects of the competition is final and no correspondence will be entered into. Any materials provided to CMRI to verify an entry (e.g. a birth certificate or pet registration document) will be used solely for that purpose and will not be publicly disclosed by CMRI.

9. CMRI has the right, in its sole discretion, to maintain the integrity of the Jeans for Genes 2023 Cute Shoot Competition, to void votes for any reason, including, but not limited to: multiple votes from the same user from different IP addresses; multiple votes from the same IP address, multiple votes using invalid email addresses, multiple votes from the same computer in excess of that allowed by the Jeans for Genes 2023 Cute Shoot Competition rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Jeans for Genes 2023 Cute Shoot Competition may be a violation of criminal and civil laws. Should such attempt be made, CMRI reserves the right to seek damages to the fullest extent permitted by law.

SELECTING THE JEANS FOR GENES 2023 CUTE SHOOT BILLBOARD WINNER

10. A shortlist of Entered Individuals for each Entry Type will be selected by CMRI within the week following the end of the Entry Period. Shortlisted entrants will be chosen based on most votes received on their photo entry on the Contest Website and confirmation of the validity of all votes. Shortlisted entrants may be asked to supply additional images of the Entered Individual and give permission to CMRI to use these additional images for the promotion of the Jeans for Genes 2023 Cute Shoot Competition and in relation to the announcement and publicity of the winner and for future Jeans for Genes Cute Shoot competitions.

ANNOUNCEMENT OF JEANS FOR GENES CUTE SHOOT BILLBOARD WINNER

11. The Cute Shoot Winner will be announced on 24 July 2023 from 4pm on the Competition Website. The winner will be notified by email using details provided in their entry form within five (5) days following the selection of the Winner. CMRI shall have no liability for the Winner’s failure to receive notices due to spam, junk e-mail or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information. If the Winner cannot be contacted, is ineligible, fails to claim the prize within 5 days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited and an alternate Winner selected. Receipt by the Winner of the prize offered in the Jeans for Genes Cute Shoot competition is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (AT CMRI'S SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE Jeans for Genes Cute Shoot competition, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

12. The Winner may also be announced in other media, for example, in a television program with consent from winner to participate, together with their Entered Child or Pet where applicable, in such reasonable announcements as requested by CMRI.

WINNER’S PRIZE

13. The Cute Shoot Billboard winner will receive confirmation that their winning photo (or another similar but more suitable photo supplied at CMRI’s request) has been displayed on a digital billboard in either Adelaide, SA; Brisbane, QLD; Sydney, NSW, or Melbourne, VIC; or Perth, WA in Australia.

14. Prize will be awarded to the winning entrant, being the Entered Child’s parent or legal guardian or the Entered Pet’s owner. Prize is not transferable or exchangeable.

15. If requested by CMRI, winners will sign a legal disclaimer on reasonable terms determined by CMRI as a condition of taking any prize.

16. All entrants consent to the use of their name and any other Content they submit, including the name and photographs of themselves, their Entered Child or Pet as the case may be, by CMRI for an unlimited period and for any purpose including promoting, publicising or marketing the Competition Website and the Jeans for Genes 2023 Cute Shoot Competition including any outcome of this competition in any media including at the Jeans for Genes website and Jeans for Genes Facebook page. Without limitation, CMRI may continue to make the Competition Website available for viewing by the public after the end of the competition, but will allow entrants to remove their entry after the end of the competition. CMRI shall ensure that any such use is reasonable and reputable. The opportunity to participate in the Jeans for Genes 2023 Cute Shoot Competition and the chance to win a prize constitutes the entire consideration payable by CMRI in respect of such use.

17. If for any reason this the Jeans for Genes 2023 Cute Shoot Competition is not capable of running as planned, including but not limited to tampering, unauthorised intervention, fraud or any other causes beyond the control of CMRI which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Jeans for Genes 2023 Cute Shoot Competition, CMRI reserves the right in its sole discretion, subject to any written directions given by any relevant authority in each State or Territory, to cancel, terminate, modify or suspend the Jeans for Genes 2023 Cute Shoot Competition.

18. CMRI may, in its sole discretion, disqualify any entries from, and prohibit further participation in the Jeans for Genes 2023 Cute Shoot Competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the Jeans for Genes 2023 Cute Shoot Competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.

19. CMRI accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction or otherwise.

20. CMRI and associated agencies and companies (and their officers, employees and agents) will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with the Jeans for Genes 2023 Cute Shoot Competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

21. All entries will be the property of CMRI. The information entrants provide will be used by CMRI for the purpose of conducting this competition. CMRI may disclose Entrants’ personal information to contractors and agents to assist in conducting the Jeans for Genes 2023 Cute Shoot Competition, to communicate with Entrants. CMRI is bound by the Australian Privacy Principles in the Privacy Act 1988.
